These Terms of Service ("Terms") govern your use of mevajhomes.com and any booking you make with MEVAJ HOMES ("Mevaj Homes", "we", "us"), a business registered in Kenya under the Registration of Business Names Act (Business No. BN-Y6SDZRMP, KRA PIN A009107806N) and licensed by the Tourism Regulatory Authority (Class A Homestay · TRA ref PH7NECWELL). By creating an account or making a booking you agree to these Terms, which are written to comply with the Consumer Protection Act, 2012.
1. Who can book
You must be at least 18 years old and able to enter a binding contract. The lead guest must be present at check-in with the original identification document used for verification.
2. Our accommodation
We operate our own bedsitter and one-bedroom units in Kitengela, Kajiado County. Photos and descriptions are accurate representations; minor differences between units of the same type (floor, view, décor) may occur. If you book "any available unit" we assign a unit of the type you booked.
3. Prices, taxes and fees
- All prices are in Kenya Shillings (KES). USD amounts, where shown, are approximate and for information only.
- Your total is shown before you pay and is itemised: accommodation (nights × nightly rate), any package discount, service fee and cleaning fee.
- There are no hidden charges. The price you confirm is the price you pay, unless you add extras on site.
- An invoice is issued for every paid booking and is available in your account.
4. Booking and payment
- When you select "Reserve & pay", we hold your unit for 15 minutes. If payment is not completed in that time, the hold lapses and the unit is released.
- A booking is confirmed only when payment is received and you receive a confirmation (SMS/email) with a booking reference.
- Payments are processed by Safaricom M-Pesa, Stripe or Flutterwave. We never see or store your card number or M-Pesa PIN.
- If a payment is received after your hold expired and the unit has been taken, we will refund you in full.
5. Identity verification and guest register
Kenyan law requires accommodation providers to keep a register of guests. You must complete ID verification (KYC) and all adult guests must present valid ID at check-in. We may refuse check-in, without refund, where valid ID is not produced. See our KYC Policy and Guest Registration Policy.
6. Cancellations, changes and refunds
Cancellations and refunds are governed by our Cancellation & Refund Policy, which forms part of these Terms.
7. Your responsibilities
- Comply with the House Rules, including occupancy limits, quiet hours, and the no-parties and no-smoking-indoors rules.
- Use the unit in a reasonable manner. You are responsible for loss or damage caused by you or your visitors beyond normal wear and tear; we will provide evidence and an itemised statement before claiming any amount.
- Not use the premises for any unlawful purpose.
8. Our responsibilities
We will provide the unit clean, safe and as described, with the listed amenities in working order. If a material problem arises that we cannot fix within a reasonable time, we will offer an alternative unit of equal or better standard or a proportionate refund. Nothing in these Terms excludes rights you have under the Consumer Protection Act, 2012 that cannot lawfully be excluded.
9. Liability
To the extent permitted by law, we are not liable for loss of or damage to personal belongings left in the unit unless caused by our negligence, nor for indirect or consequential losses. Our total liability for any booking is limited to the amount you paid for it, except for death or personal injury caused by our negligence or where the law does not allow a limitation.
10. Early departure and eviction
If you leave early, unused nights are not refundable unless we agree otherwise. We may end a stay without refund where there is a serious breach of the House Rules (for example, a party, violence, illegal activity or exceeding occupancy limits) after giving you an opportunity to remedy where reasonable.
11. Privacy
We process personal data in accordance with the Data Protection Act, 2019. See our Privacy Policy and Cookie Policy.
12. Complaints and disputes
Please raise any issue with us first at mevajhomes@gmail.com or +254700179924; we aim to respond within 2 working days. If unresolved, you may refer the matter to the Competition Authority of Kenya (consumer protection) or the Tourism Regulatory Authority, or to the courts of Kenya. These Terms are governed by the laws of Kenya.
13. Changes
We may update these Terms. The version that applies to your booking is the one you accepted when you booked.
