These terms (version 1) apply to people and companies that MEVAJ HOMES invites to refer guests to our stays in Kitengela ("partners"). You accept them in your partner dashboard before your referral link is activated.
1. Who can be a partner
- Partners join by invitation from MEVAJ HOMES. You must be 18 or older, resident in Kenya and have a KRA PIN. We need the PIN to deduct and remit withholding tax.
- Our staff and their household members cannot be partners.
- This is a single-level programme. You earn only on stays you refer. Nobody earns for recruiting other partners, and there is no joining fee or investment.
2. How a referral is counted
- You get a personal link (
/r/YOURCODE) and a code. A booking counts as yours when the guest opens your link and books within 30 days, or types your code when reserving. - If the guest types a code, that code wins. One partner is credited per booking.
- Bookings you make for your own stay do not earn commission.
- The guest pays exactly the same price as booking directly. Commission comes out of our margin, never from the guest.
3. How commission is calculated
The standard rate is 10% unless your invitation states another rate. It is calculated on the accommodation value: nights × nightly rate, less any package discount. It excludes VAT, tourism levy, cleaning and service fees, which is the usual basis for hotel commissions worldwide.
Example: 3 nights at KES 3,000 = KES 9,000 accommodation → commission KES 900.
4. When commission is earned
- Pending: when the guest has paid in full.
- Approved (available to withdraw): 7 days after the guest checks out.
- Void: if the booking is cancelled, the guest is a no-show, the payment is reversed or charged back, or it is fully refunded. A partial refund reduces the commission in proportion.
5. Payouts and tax
- Once your approved balance reaches KES 1,000 it is paid to you automatically (normally the same night it is approved) to the M-Pesa number, Kenyan bank account, Paybill or Till you choose in your payout details. The account must be in your name or your business's name. If automatic payment is paused, you can request a payout and we pay within 3 working days.
- Kenyan withholding tax of 5% is deducted from each payout under the Income Tax Act (Cap. 470). We remit it to KRA, and the withholding certificate appears on your iTax account.
- You remain responsible for declaring your commission income. If you are VAT-registered, send us a tax invoice (eTIMS) for your commission.
- We may withhold or reverse commission obtained through fraud, fake bookings or a breach of these terms.
6. How you may promote us
- Describe our stays, prices and policies accurately. Do not promise discounts, upgrades or services we have not approved. The Consumer Protection Act, 2012 prohibits false or misleading representations.
- Tell people you earn a commission when you recommend us.
- Do not send unsolicited bulk SMS or email ("spam"). Only contact people who have agreed to hear from you, as the Data Protection Act, 2019 requires for direct marketing.
- Do not pretend to be MEVAJ HOMES, and do not use our name in paid search ads or in business or domain names without written permission.
7. Personal data
- You will not receive guests' personal data. Your dashboard shows only booking dates and amounts.
- We process your name, contact details, KRA PIN and payout details to run the programme, pay you and meet tax law. Identity and payout details are encrypted.
- Payout records are kept for at least five years, as the Tax Procedures Act, 2015 requires. Your other rights are set out in our Privacy Policy.
8. Suspension, ending and changes
- Either side may end the partnership at any time. Approved commission is still paid, unless it was obtained in breach of these terms.
- We may change the rate or these terms for future bookings. We will tell you first and ask you to accept the new version.
- These terms are governed by the laws of Kenya.
